1. Acceptance of these terms

By downloading, installing, or using Sonary (the “App”), you agree to these Terms & Conditions (“Terms”) and to our Privacy Policy and End User License Agreement, which are incorporated by reference. If you do not agree, do not use the App.

2. The service

Sonary is a mobile audio toolkit. It lets you:

• Extract audio from video, convert between audio formats (MP3, WAV, M4A, AAC, FLAC), trim, cut, split, and merge audio, and record audio — all running on your device.
• Run AI features — vocal/instrument separation (stem separation), karaoke/instrumental extraction, and background-noise removal — either on-device or via a cloud AI job you explicitly start.

Some features are free; some require a subscription or consumable credits (see §§5–6). We may add, change, or remove features over time.

3. Eligibility

Sonary is a general-audience app and is not directed at children under 13 (or the equivalent minimum age in your region). By using the App you represent that you meet this age requirement and, if you are under the age of majority in your jurisdiction, that a parent or guardian has reviewed and agreed to these Terms on your behalf.

4. No account required

Sonary does not require you to create an account or provide your name or email address to use it. Purchases and entitlements are tied to your app-store account and an anonymous, app-generated identifier (see the Privacy Policy §2.2). Because there is no Sonary account, there is nothing for us to “delete” beyond the data described in the Privacy Policy.

5. Subscriptions, trials & billing

• Plans. Sonary offers Pro subscriptions billed weekly, monthly, or yearly. Pro removes ads, unlocks unlimited utility use, and includes a periodic AI-minute allowance (exact allowances and prices are shown in the app and may change — the price shown in the App at the time of purchase controls).
• Free trials. Some plans include an introductory free trial (currently 3 days on weekly, 7 days on yearly). If you don’t cancel before the trial ends, you will be charged for the plan you selected.
• Auto-renewal. Subscriptions automatically renew for the same term unless cancelled at least 24 hours before the current period ends. You will be charged through your app-store account (Google Play or Apple App Store) at the start of each renewal period.
• Managing & cancelling. Manage or cancel your subscription any time through your app-store account settings (Google Play → Subscriptions, or Settings → [your name] → Subscriptions on iOS). Cancelling stops future renewals; it does not refund the current period.
• Price display. We show the actual amount you will be billed, the renewal term, and trial length before you confirm any purchase, and a working “Restore Purchases” option is always available.

6. Credits (minute top-ups)

• Credits are sold as AI minutes and let you run cloud AI jobs without a subscription, or top up beyond your subscription’s periodic allowance.
• Purchased credits never expire. Subscription period allowances do not roll over between periods and do not carry the “never expire” guarantee.
• Credits are debited only when a job completes successfully; if a job fails, any debited credit is automatically refunded to your balance.
• Credits have no cash value, are non-transferable between devices/app-store accounts, and cannot be redeemed for cash or exchanged outside the App.

7. Free tier & advertising

The free tier is supported by ads (via AppLovin MAX) and includes a limited AI-minute allowance you can top up by watching optional rewarded ads or purchasing credits. We do not show ads that interrupt a job you’ve started or a result you’ve reached, and free exports are never watermarked. Purchasing Pro removes all ads.

8. Your content

• You own your content. Any audio, video, or recordings you process through Sonary (“Your Content”) remain yours. We claim no ownership over Your Content.
• Limited processing license. By using a feature, you grant us the limited right to process Your Content solely to perform the specific task you requested (for example, running a cloud AI separation job) — including transmitting it to our processing provider (Replicate) when you use a cloud AI feature. This license ends once the job is complete and the file is deleted from the processing servers, per the Privacy Policy §3.
• No training on your content. We do not use Your Content to train AI models.
• Your responsibility. You are solely responsible for Your Content and for having the rights needed to process it (see §9 — Acceptable Use).

9. Acceptable use

You agree not to use Sonary to:

• Process content you don’t have the legal right to use, copy, or modify (including copyrighted material without permission), or to infringe anyone’s intellectual property or other rights.
• Upload or generate unlawful, defamatory, obscene, or otherwise harmful content.
• Reverse-engineer, decompile, or extract the App’s on-device AI models or native libraries except where such restriction is prohibited by law or by the license of an open-source component we use (see EULA §4).
• Abuse, automate, or farm the rewarded-ad or credit system (for example, using bots, emulators, or multiple accounts to generate artificial ad views or credits).
• Interfere with, overload, or attempt to gain unauthorized access to our backend services.
• Violate any applicable law or the terms of any third-party service the App relies on (§11).

We may suspend or terminate access for violations of this section (§17).

10. Intellectual property

Sonary — including its software, design, branding, and (excluding Your Content) all AI model outputs generated on our infrastructure — is owned by New Age Devs or its licensors and is protected by intellectual-property laws. These Terms grant you a license to use the App (see the EULA); they do not transfer any ownership in the App itself to you.

11. Third-party services

Sonary relies on third-party services to operate, each governed by its own terms: Google Play Billing (purchases), RevenueCat (subscription & entitlement management), AppLovin MAX (advertising), Replicate (cloud AI processing), and Firebase (analytics, crash reporting, remote configuration). See the Privacy Policy §5 for what each processes. Your use of features backed by these services is also subject to their respective terms where applicable.

12. Refunds

• Subscriptions and credit purchases are billed through Google Play or the Apple App Store. Refund requests are handled under their refund policies — contact Google Play or Apple App Store support directly, or use the store’s refund-request flow.
• In-app credit failures are handled automatically: if a cloud AI job you paid credits for fails, the credit is refunded to your in-app balance without a support request.

13. Disclaimers & no warranty

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not guarantee that AI-generated output (for example, vocal/instrumental separation or noise removal) will be error-free, complete, or meet your expectations — AI processing results can vary by input quality and content. We do not guarantee the App will be uninterrupted, secure, or error-free.

14. Governing law & disputes

These Terms are governed by the laws of Bangladesh, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App is subject to the exclusive jurisdiction of the courts of Bangladesh, except where applicable consumer-protection law in your country of residence gives you the right to bring a claim in your local courts instead.

15. Limitation of liability

To the maximum extent permitted by law, New Age Devs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the App. Our total liability for any claim arising from these Terms or the App will not exceed the amount you paid us in the 12 months before the claim arose (or USD $20 if you have not paid us anything), except where a higher cap is required by applicable law.

16. Indemnification

You agree to indemnify and hold New Age Devs harmless from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your violation of these Terms, or your violation of any law or third-party right.

17. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App (or specific features) if you violate these Terms, engage in fraudulent or abusive behavior, or if we discontinue the App or a feature. Because there is no account to delete, termination primarily affects your ability to use paid features going forward; it does not retroactively affect purchases already made (see §12 for refunds).

18. Changes to these terms

We may update these Terms as the App evolves. We’ll update the “Last updated” date above, and for material changes we’ll provide an in-app notice where appropriate. Continued use of the App after a change means you accept the updated Terms.
